上海市见义勇为人员奖励和保护办法 第一条 (目的) 为了奖励和保护见义勇为人员,弘扬社会正气,维护社会秩序,加强社会主义精神文明建设,根据本市实际,制定本办法。 第二条 (含义) 本办法所称的见义勇为,是指个人为保护国家利益、公共利益或者他人的人身、财产安全,制止违法犯罪、协助有关机关打击违法犯罪活动以及抢险救灾的行为。 第三条 (适用范围) 本办法适用于本市范围内见义勇为行为的确认和对见义勇为人员的奖励、保护。 法律法规对见义勇为人员已有奖励和保护规定的,从其规定。 第四条 (原则) 对见义勇为人员实行精神鼓励与物质奖励相结合的原则。见义勇为人员的合法权益受法律保护。 第五条 (管理部门) 本办法由市和区、县人民政府组织实施,对见义勇为人员奖励和保护的具体工作由各级社会治安综合治理委员会(以下简称综治委)负责。 公安、民政、劳动保障、卫生、医保、财政等行政管理部门按照各自职责,做好见义勇为人员奖励和保护的相关工作。 新闻出版、文广影视、教育等部门和工会、妇联、共青团、残联等群众团体应当做好见义勇为的宣传工作。 第六条 (专项经费) 本市设立见义勇为专项经费(以下简称专项经费)帐户,由市综治委负责日常管理。专项经费用于见义勇为人员的奖励和保护。 专项经费的使用和管理,依法接受财政、审计等有关部门监督和社会监督。 第七条 (专项经费筹集) 专项经费通过下列途径筹集:(一)政府财政拨款;(二)社会捐赠;(三)其他合法途径。 第八条 (专项经费用途) 专项经费主要用于:(一)见义勇为人员的表彰、奖励、慰问;(二)因见义勇为而牺牲、伤残人员的补助;(三)办理因见义勇为而牺牲、伤残人员的无记名人身保险。 第九条 (评审机构) 市和区、县综治委设立见义勇为评审委员会(以下简称评审委员会)。评审委员会由综治委办公室和公安、民政、劳动保障、医保、财政等部门及精神文明办、工会、妇联、共青团、残联等单位组成。 区、县评审委员会负责对见义勇为行为确认申报的审核。 市评审委员会行使下列职权:(一)确认见义勇为行为;(二)评定见义勇为先进分子;(三)对有异议的见义勇为行为确认行为、见义勇为先进分子评定行为进行复核。 第十条 (确认见义勇为行为的条件) 个人有下列行为之一的,应当确认为见义勇为行为:(一)当国家利益、公共利益、集体财产或者他人的人身、财产权利受到不法侵害或者遭受危害时,进行制止或者予以救助的;(二)除受害当事人之外的个人向公安部门及其他有关部门检举、揭发违法犯罪行为,为侦破犯罪案件和追捕、抓获罪犯、犯罪嫌疑人起到重要作用的;(三)抢险救灾中,保护国家财产、公共财产、集体财产或者他人的财产和人身安全的;(四)其他应当确认为见义勇为的行为。 为履行法定职责实施了前款所列的见义勇为行为的,按照其他有关规定予以奖励和保护。 第十一条 (见义勇为行为的申报) 单位和个人可以向区、县综治委申报确认见义勇为行为。申报人应当填写见义勇为行为确认申报表。 见义勇为行为发生地以外的区、县综治委收到申报表后,应当及时将申报表移送行为发生地的区、县综治委。 第十二条 (行为确认) 见义勇为行为发生地的区、县综治委收到申报表后,应当调查核实,收集和保存有关证据材料,组织区、县评审委员会进行审核,提出审核意见,报市综治委。 市综治委收到上报的材料后,应当及时组织市评审委员会予以确认。对符合条件的,发给证书;对不符合条件的,应当书面告知申报人。 第十三条 (表彰、奖励) 事迹突出的见义勇为人员,经市评审委员会评定后,由市综治委授予见义勇为先进分子荣誉称号,并给予物质奖励。 对见义勇为先进分子的表彰可以公开进行,也可以秘密进行。公开表彰应当事先征得当事人的同意。 第十四条 (确认和评定的复核) 申报人或者其他人员对见义勇为行为的确认和见义勇为先进分子的评定有异议的,可以向市综治委申请复核。 市综治委应当组织市评审委员会进行复核,并将复核结果告知申请人。 第十五条 (见义勇为的宣传) 区、县应当对见义勇为人员予以宣传、表扬、奖励;新闻媒体应当及时宣传、报道见义勇为人员及其事迹,但需要保密或者当事人要求保密的除外。 第十六条 (优先待遇) 被授予见义勇为先进分子荣誉称号的人员报考学校或者应聘就业时,在同等条件下,学校、单位应当优先录取、录用。 第十七条 (救治义务) 任何单位和个人对因见义勇为而负伤的人员,应当及时送往医疗机构抢救和治疗。 第十八条 (抢救费用的暂付) 见义勇为人员因见义勇为负伤而发生的抢救费用,有工作单位的,由其单位暂付;无工作单位或者单位未予暂付的,从专项经费中暂付。 第十九条 (医疗费用的支付) 见义勇为人员因见义勇为负伤而发生的医疗费用,由医疗保险机构按照国家和本市有关规定支付后的不足部分,从专项经费中支出。 第二十条 (伤残评定和烈士追认) 见义勇为人员的伤残评定、烈士追认,由民政等有关部门按照国家和本市的有关规定予以认定,并给予相应的抚恤。 第二十一条 (保护措施) 对需要保密的见义勇为人员或者见义勇为人员要求保密的,有关评审、表彰、宣传部门应当为其保密。 见义勇为人员及其家属因见义勇为行为致使其人身、财产安全受到威胁的,公安部门应当采取有效措施予以保护。 对见义勇为人员进行打击报复的,由有关部门依法处理。 第二十二条 (监督措施) 有关部门和见义勇为人员所在单位对见义勇为人员负有保护义务而不履行的,见义勇为人员或者其家属可以向市或者区、县综治委提出申诉。市和区、县综治委应当监督有关部门和单位履行保护义务。 第二十三条 (施行日期) 本办法自2002年5月10日起施行。 Procedures of Shanghai Municipality on The Reward, Encouragement, And Protection of Voluntary Felon-fighters Article 1 (Purpose) In order to reward and protect Voluntary Felon-Fighters (hereinafter referred to as VFF), develop moral courage in society, maintain social order, and promote socialist ethical and cultural progress, these Procedures are formulated in line with this municipality's actual circumstances. Article 2 (Definition) Voluntary felon-fighting under these Procedures refers to the act done by an individual person for protecting State interests, public interests or other person's personal and property safety, curbing law violation and crime, and assisting related organs in cracking down on illegal and criminal activities and in emergency and disaster relief. Article 3 (Scope of Application) These Procedures apply to the confirmation of voluntary felon-fighting deed and the reward, encouragement, and protection of VFF in this municipality's area. Where laws and regulations have already provisions on rewarding, encouraging, and protecting VFF, such provisions shall prevail. Article 4 (Principle) The principle of combining spiritual encouragement with material awards shall be carried out on VFF. The legitimate rights and interests of VFF shall be protected by law. Article 5 (Administrative Department) The municipal, district and county people's governments shall organize the implementation of these Procedures, and the social order comprehensive regulating committees at all levels (hereinafter referred to as the CRC) shall be responsible for the specific work of rewarding, encouraging, and protecting VFF. The public security, civil affairs, labor security, public health, medical insurance, finance and other administrative departments shall, according to their respective duties, do well the work relating to the reward, encouragement, and protection of the VFF. The press and publication, culture, radio, film and television, education and other sectors, and trade unions, women's federations, communist youth leagues, handicapped persons' federations and other mass organizations shall do a good job of publicity on voluntary felon-fighting. Article 6 (Special Funds) This Municipality shall set up accounts of special funds for voluntary felon-fighting (hereinafter referred to as special funds) with the routine management in the charge of the municipal CRC. The special funds are used for the reward, encouragement, and protection of the VFF. The use and management of special funds are, according to law, under the supervision of finance, auditing and other relevant departments, as well as under the surveillance of society. Article 7 (Raising of Special Funds) Special funds shall be raised through the following channels: (1) Financial allocation of the government; (2) Donations from society; (3) Other legal channels. Article 8 (Uses of Special Funds) Special funds shall mainly be used for: (1) The commendation, reward and encouragement, and expression of gratitude and appreciation of VFF; (2) Subsidies to persons killed, injured or disabled due to voluntary felon-fighting; (3) Taking out bearer personal insurance for person killed, injured or disabled due to voluntary felon-fighting. Article 9 (Appraisal and Examination Organization) The municipal, district and county CRCs shall set up voluntary felon-fighting appraisal and examination committees (hereinafter referred to as the appraisal committees). The appraisal committees shall be made up by CRC offices and public security, civil affairs, labor security, medical insurance, finance and other departments as well as spiritual and cultural offices, trade unions, women's federations, communist youth leagues, handicapped persons' federations and other units. The district and county appraisal committees are responsible for the examination and verification of the affirmation report of voluntary felon-fighting deeds. The municipal appraisal committee executes the following functions and powers: (1) Affirmation of voluntary felon-fighting deeds; (2) Evaluation of advanced element in voluntary felon-fighting; (3) Re-check of the affirmation of voluntary felon-fighting deeds and the evaluation of advanced element in voluntary felon-fighting that incur disagreement. Article 10 (Conditions for Affirmation of Voluntary Felon-Fighting Deeds) Any of the following acts an individual person has done shall be affirmed as a voluntary felon-fighting deed: (1) Putting a curb or going to the rescue when State, public or collective interests, or other person's personal or property rights were illegally infringed upon or jeopardized; (2) An individual person other than the victim reports and exposes wrongful or criminal acts to the public security department and other relevant departments, playing an important role in investigating and solving criminal cases and in pursuing and capturing offenders and suspects of crimes; (3) In emergency and disaster relief, protecting State, public or collective property or other person's property and personal safety; (4) Other voluntary felon-fighting deeds that should be affirmed. Those who make voluntary felon-fighting deeds listed in the preceding clause for performing statutory duties shall be rewarded, encouraged, and protected according to other relevant provisions. Article 11 (Declaration of Voluntary Felon-Fighting Deeds) Any unit and individual person may apply to the district or county CRC for the affirmation of voluntary felon-fighting deed. The applicant shall write an application for the affirmation of voluntary felon-fighting deed. The district/county CRC outside of the scene of voluntary felon-fighting deed, when receiving such application, shall refer it in time to the district/county CRC in the locality where such deed occurs. Article 12 (Affirmation of Deeds) The district/county CRC at the scene of a voluntary felon-fighting deed, when receiving an application, shall make investigation and verify, collect and keep related evidence material, organize the appraisal committee to conduct examination and verification, put forward examination and verification opinions and report to the municipal CRC. The municipal CRC, when receiving the submitted material, shall organize in time the municipal appraisal committee to make affirmation and grant a certificate to the person who meets the requirements or, for the person who does not meet the requirements, give a notice in writing to the applicant. Article 13 (Commendation and Reward) The VFF with an outstanding deed, upon evaluation by the municipal appraisal committee, shall be awarded the honorary title of advanced element in voluntary felon-fighting and given material awards by the municipal CRC. Commendation of advanced element in voluntary felon-fighting may be conducted either in the open or in secret. Commendation in the open shall seek the consent of the party concerned beforehand. Article 14 (Re-check of Affirmation and Evaluation) The applicant or any other person who disagrees with the affirmation of voluntary felon-fighting deed and the evaluation of advanced element in voluntary felon-fighting may apply to the municipal CRC for re-check. The municipal CRC shall organize the municipal appraisal committee to make re-check and inform the applicant of the results of re-check. Article 15 (Publicity of Voluntary Felon-Fighting) Districts and counties shall publicize, commend and reward the VFF; press media shall make timely publicity, reporting VFF and their deeds with the exception of those in need of confidentiality or to be kept in secret at the request of the party concerned. Article 16 (Priority Treatment) The person awarded the honorary title of advanced element in voluntary felon-fighting, when applying for admission to school or for employment, shall have priority in enrolment or recruitment under the equal condition by the school or the unit. Article 17 (Duty to Treat and Cure) Any unit or individual person shall take timely the person injured in voluntary felon-fighting to a medical institution for emergency treatment and cure. Article 18 (Temporary Payment of Emergency Treatment Expenses) The VFF's emergency treatment expenses incurred for injuries in voluntary felon-fighting shall be temporarily paid by his or her unit, if any, or derived from special funds temporarily if the VFF has no unit or his/her unit has not made the temporary payment. Article 19 (Payment of Medical Expenses) The VFF's medical expenses incurred for injuries in voluntary felon-fighting shall be paid by the medical insurance organization according to relevant provisions of the State and this municipality with the shortage derived from special funds. Article 20 (Assessment of Injuries and Deformities, and Posthumous Conferral of Martyr Title) The assessment of injuries and deformities and posthumous conferral of martyr title for VFF shall be ascertained by the civil affairs and other related departments according to relevant provisions of the State and this Municipality and appropriate pensions shall be given. Article 21 (Protective Measures) For VFF in need of confidentiality or those who ask for confidentiality, the related appraisal, commendation and publicity departments shall keep secret. For VFF and their family whose personal and property safety are threatened due to voluntary felon-fighting deeds, the public security department shall take effective measures to give protection. Any retaliation against VFF shall be dealt with by relevant departments according to law. Article 22 (Supervisory Measures) If relevant departments and the unit the VFF is affiliated with fail to perform their duty of protecting the VFF as they should do, the VFF or his/her family may appeal to the municipal or district/county CRC, which shall supervise the relevant departments and the unit in performing their duty of protection. Article 23 (Effective Date) These Procedures shall become effective on May 10, 2002. |
