纺织品出口自动许可暂行办法
斗闹品出口自动许可暂行办法》已经2005年1月30日商务部第2次部务会议审议通过,现予公布,自2005年3月1日起施行。 部长:薄熙来 纺织品出口自动许可暂行办法 第一条 为加强对纺织品出口的统计分析和监测,及时向出口经营者发布纺织品出口预警信息,根据《中华人民共和国对外贸易法》,制定本办法。 第二条 商务部是纺织品出口自动许可的管理机关,会同海关总署负责制定、调整《纺织品出口自动许可目录》,并在实施前30天,特殊情况下不迟于实施前21天以商务部公告等形式对外公布。对列入《纺织品出口自动许可目录》的纺织品通过《纺织品出口自动许可证》实施出口自动许可管理。 第三条 商务部授权配额许可证事务局统一管理、指导全国各发证机构(发证机构名单见附件1)的《纺织品出口自动许可证》发证工作,配额许可证事务局对商务部负责。 配额许可证事务局及各地方商务主管部门为《纺织品出口自动许可证》的发证机构,在配额许可证事务局统一管理下,负责授权范围内的发证工作。 第四条 《纺织品出口自动许可证》(证书样本见附件2)和出口自动许可证专用章(样章见附件3)由商务部负责统一监制并发放至发证机构。各发证机构必须指定专人保管,专管专用。 第五条 列入《纺织品出口自动许可目录》的商品,出口经营者在办理海关出口报关手续前,须向发证机构提出自动许可申请并提供以下书面材料: (一)纺织品出口自动许可证申请表(样表见附件4,出口经营者可到发证机构领取或从商务部网站下载打印); (二)货物出口合同。 首次申请《纺织品出口自动许可证》的出口经营者,除上述材料外,还应向各发证机构提供以下材料的复印件: (一)营业执照; (二)进出口企业资格证书或对外贸易经营者备案登记表或外商投资企业批准证书; (三)企业年检或外商投资企业联合年检合格证明材料(新设企业可不提交)。 上述材料在备案后如发生变化,出口经营者须及时向各发证机构再次提供。 出口经营者应当对所提交材料的真实性负责,并保证其有关经营活动符合国家法律规定。如果发证机构发现上述材料有错误的,可以责令出口经营者作出修改。 第六条 出口经营者可通过网上申请《纺织品出口自动许可证》。网上申请时,出口经营者可登录指定网站,进入相关申领系统,并按要求在线填写纺织品出口自动许可证申请表(电子表格)。 凡通过网上申请的,出口经营者在领取证书时,须向发证机构提供第五条规定的书面材料。 第七条 各发证机构收到内容正确且形式完备的自动许可申请后,应当予以签发《纺织品出口自动许可证》,最多不超过10个工作日。 第八条 海关在办理相关纺织品出口手续时,须验核加盖出口自动许可证专用章的《纺织品出口自动许可证》。 第九条 商务部将定期在政府网站上公布《纺织品出口自动许可目录》所涉商品的信息。 第十条 《纺织品出口自动许可证》实行"一批一证""一证一关",在公历年度内有效,有效期3个月,逾期作废。《纺织品出口自动许可证》不得买卖、转让、涂改、伪造和变卖。 第十一条 《纺织品出口自动许可证》如有遗失,出口经营者应立即向原发证机构和《纺织品出口自动许可证》证面注明的报关口岸海关书面报告挂失,原发证机构收到挂失报告后,经核实无不良后果的,予以重新补发。 第十二条 未申领《纺织品出口自动许可证》,擅自出口纺织品出口自动许可管理货物的,由海关依照有关法律、行政法规的规定处理。 第十三条 伪造、变造、买卖《纺织品出口自动许可证》或者以欺骗等不正当手段获取《纺织品出口自动许可证》的,依照有关法律、行政法规的规定处理。 第十四条 纺织品出口自动许可适用于所有贸易方式下对全球或者重点国家、地区的出口。具体监管方式见附件5. 第十五条 对从境内区外进入保税区、出口加工区等海关特殊监管区域的列入《纺织品出口自动许可目录》的纺织品,按《保税区海关监管办法》(国函(1997)48号)和《中华人民共和国海关对出口加工区监管的暂行办法》(国务院令第389号)的规定办理。 第十六条 本办法由商务部负责解释。 第十七条 本办法自2005年3月1日起施行。 Temporary Measures of Automatic Permission for Textile Export Article 1 For the purposes of improving the analysis and monitoring of the statistics of textile exports, releasing forewarning information of textile export to export managers in time, these measures are formulated in accordance with Foreign Trade Law of the People's Republic of China. Article 2 Ministry of Commerce is the administration of automatic permission for textile export. It is responsible for formulating, readjusting Catalogue of Automatic Permission for Textile Export together with General Administration of Customs. The Catalogue should be published in the form of announcement of Ministry of Commerce 30 days before the implementation, and no later than 20 days before the implementation if the case is special. The textiles listed in the Catalogue of Automatic Permission for Textile Export are carried out export automatic permission in the light of Automatic License of Textile Export. Article 3 Ministry of Commerce authorizes Bureau of Quota License Affairs to manage uniformly and guide all license issuing organs (for license issuing organs, see Appendix 1) to carry out the issuing of Automatic License of Textile Export. Bureau of Quota License Affairs should be accountable to the Ministry of Commerce. Bureau of Quota License Affairs and all competent local commercial administrations are the license issuing organs of Automatic License of Textile Export and responsible for license issuing in the scope of the authority under the uniform management of Bureau of Quota License Affairs. Article 4 Automatic License of Textile Export (for the sample of it, see Appendix 2) and Special Seal for Export Automatic License (for the sample of the seal, see Appendix 3) are manufactured under the uniform supervision of the Ministry of Commerce and issued to license issuing organs by the Ministry of Commerce. All license issuing organs must appoint special persons to take care of them, special care for special use. Article 5 Export managers should make an application for automatic permission for the commodities listed in the Catalogue of Automatic Permission for Textile Export before handling export declaration in the customs and submit following written materials: 1. The application form of automatic license for textile export (for the sample form, see Appendix 4, export managers may obtain it from license issuing organs or download and print it from the Internet of the Ministry of Commerce); 2. Goods export contract; Besides above materials, the export managers who apply for Automatic License of Textile Export for the first time should provide the copies of following materials: 1. Business license; 2. Credentials of import and export enterprises or registration form for the record of foreign trade managers or approval certificate of foreign invested enterprises; 3. Certificate materials of annual examination of the enterprises or joint annual examination of foreign invested enterprises up to the standard (newly established enterprises are allowed not to provide them); Export managers should provide above materials again to all license issuing organs in time in case there are any changes of them after the record. Export managers should be responsible for the truthfulness of the submitted materials and ensure their business activities accord with the provisions of national laws. License issuing organs may order export managers to make revisions in case that mistakes are found in the materials. Article 6 Export managers may apply for Automatic License of Textile Export from Internet. While making application in the Internet, export managers may enter assigned website, get into relevant application system and file in the application form of automatic license for textile export (spreadsheet) according to the requirements. Export managers who make the application in the Internet should provide the license issuing organs with written materials stipulated in Article 5. Article 7 All license issuing organs should issue Automatic License of Textile Export in no more than 10 working days after receiving correct and complete application for automatic permission. Article 8 The customs should examine Automatic License of Textile Export with affixed special seal for export automatic license while handling relevant formalities of textile export. Article 9 The Ministry of Commerce will publish the information of the commodities relating Catalogue of Automatic Permission for Textile Export regularly in the governmental website. Article 10 Automatic License of Textile Export is carried out in the form of “one batch one license” and “one license one customs”. It is effective within a Gregorian calendar year for a period of three months and becomes invalid upon expiration. Automatic License of Textile Export should not be bought and sold, transferred, altered, faked and sold off. Article 11 If Automatic License of Textile Export is lost, export managers should report for the loss of it immediately to the original license issuing organ and the clearance port of customs indicated in Automatic License of Textile Export. The original license issuing organ should reissue it after verification of no harmful consequences at the receipt of the loss report. Article 12 Whoever exports the commodities subject to the management of automatic permission for textile export by himself without applying for Automatic License of Textile Export will be punished by the customs in accordance with the provisions of relevant laws, administrative laws and regulations. Article 13 Whoever fakes, revises, buys and sells Automatic License of Textile Export or obtains it by illegal means should be punished in accordance with the provisions of relevant laws, administrative laws and regulations. Article 14 Automatic permission of textile export applies to the exports to all over the world or important countries and regions in all methods of conducting trade. For the specific method of supervision, see Appendix 5. Article 15 The textile listed in Catalogue of Automatic Permission for Textile Export entering bonded areas, export processing zone and special areas supervised by the customs inside China and outside the areas are handled in accordance with the provisions of Customs Supervision Measures of Bonded Areas, and Temporary Measures of GAC of PRC on the Supervision of Export Processing Zone. Article 16 The interpretation of these Measures shall be vested in the Ministry of Commerce. Article 17 These Measures shall come into effect as of March 1, 2005. |
