市经委、市发展改革委制订的《上海市绿色电力认购营销试行办法》已经市政府同意,现转发给你们,请按照执行。

上海市绿色电力认购营销试行办法

第一章 总则

第一条 为了推进本市绿色电力开发利用,改善能源结构,促进环境保护和可持续发展,营造全社会关心绿色电力发展的良好氛围,根据《中华人民共和国节约能源法》和《中华人民共和国可再生能源法》等有关法律规定,结合本市实际,制订本办法。

第二条 本办法所称绿色电力,是指由风能、太阳能等可再生能源生产上网的电力。

第三条 政府、电力企业、社会共同支持建设绿色电力项目。

第四条 本市鼓励绿色电力发展,鼓励单位和个人自愿认购绿色电力。

第五条 上海市发展和改革委员会(以下简称“市发展改革委”)和上海市经济委员会(以下简称“市经委”)根据各自的职责,负责绿色电力认购、营销的监督管理。

上海市节能监察中心负责绿色电力认购、营销的日常监管工作。

上海市电力公司、崇明电力公司(以下统称“电力公司”)是本市绿色电力的营销单位。

第二章 绿色电力购售

第六条 单位和个人认购绿色电力需支付的认购费用,按绿色电力认购单价和认购电量计算。认购电量按规定程序,由用户自愿登记认购。

第七条 市发展改革委安排绿色电力年度指导计划。绿色电力购售按年度计划进行,并由电力公司做好购售电量平衡工作。若当年购入电量大于销售电量,应结转至下一年,增加销售电量;若当年购入电量小于销售电量,则应结转至下一年,减少销售电量。

第八条 认购绿色电力,可通过拨打电话(上电热线95598)、发送信件、登录上海绿色电力网站,或到电力公司有关营业网点登记等方式,提出申请。

单位用户与电力公司签订绿色电力销售协议后,成为绿色电力用户。

个人用户收到电力公司带邮资的函件,经确认并回复后,成为绿色电力用户。

第九条 单位用户认购的绿色电力电量,以6000千瓦时为一个单位,并以用户上一年用电量为基准,确定认购的最低额度。

(一)年用电量在200万千瓦时及以下的,最低额度为10个单位;

(二)年用电量在200万千瓦时以上、500万千瓦时及以下的,最低额度为20个单位;

(三)年用电量在500万千瓦时以上、2000万千瓦时及以下的,最低额度为50个单位;

(四)年用电量在2000万千瓦时以上、5000万千瓦时以下的,最低额度为80个单位;

(五)年用电量在5000万千瓦时及以上的,最低额度为100个单位。

个人用户每年认购的绿色电力电量,最低额度为10个单位(以12千瓦时为一个单位)。

第十条 认购绿色电力的年限分别为一年、二年和三年。绿色电力认购费用通过现行电费收缴渠道和方式,逐月支付。

第十一条 电力公司根据年度绿色电力指导计划,开展绿色电力营销,并与确定的绿色电力用户建立绿色电力购售关系。同时,电力公司按季度、年度做好绿色电力购售统计表,并报送市发展改革委和市经委。

上海市节能监察中心按年度对绿色电力电量购售、收费和用户增减等情况进行监管。

第三章 绿色电力价格管理

第十二条 利用可再生能源发电,其上网电价实行政府定价或招标定价。政府定价按照有利于促进可再生能源开发利用、经济合理和合理补偿成本、合理确定收益的原则确定。目前绿色电力暂不参与电力市场竞价上网,以后随着电力体制改革的推进,逐步建立和完善竞争性可再生能源市场。

第十三条 可再生能源发电项目的上网电价高于常规能源发电上网电价的电费差额,通过绿电认购办法消化,或按国家规定,在销售电价中进行分摊。

第十四条 认购绿色电力,按认购单价和认购电量进行结算。绿色电力认购单价按年度绿色电力平均上网电价与国家核定的上海市燃煤新机组标杆上网电价的差价确定,由市物价部门每年核准一次,与年度认购计划一起公布。

第十五条 可再生能源发电项目要通过招标、严格考核、加强管理、技术进步等措施,降低绿色电力的成本,逐步建立和完善控制绿色电力成本的机制。

第四章 鼓励措施

第十六条 上海市节能监察中心定期向社会公布绿色电力用户名单,并对购买绿色电力的用户授予荣誉证书。

第十七条 绿色电力用户与电力公司签署两年或两年以上,且年认购绿色电力在100万千瓦时以上和认购绿色电力量占生产的主要产品上年用电量10%以上协议的,由市发展改革委和市经委委托上海市节能监察中心发放绿色电力标识。

获得绿色电力标识的用户,可在购买期内使用绿色电力标识。

第十八条 对购买绿色电力成绩显著的用户,由市发展改革委和市经委颁发奖牌。

第五章 绿色电力监管

第十九条 电力公司应设立绿色电力帐目,在绿色电力用户的电费帐单上增设绿色电力购买项,并定期向社会公布绿色电力生产、购售情况。

第二十条 市发展改革委应定期检查绿色电力的年度计划、价格执行和资金使用情况,并每年委托审计机构对绿色电力价格执行和资金使用情况进行审计。

第二十一条 市质量技监部门应加强对用于绿色电力贸易结算的计量器具的监管,并依法对计量违法行为进行查处。

第二十二条 上海市节能监察中心应掌握绿色电力认购营销情况,定期向市经委报送情况报告、提出有关措施建议,协助营销单位制定和实施绿色电力营销计划。同时,受市发展改革委和市经委委托,发放绿色电力标识,制止违规使用绿色电力标识的行为。

第六章 附则

第二十三条 市发展改革委和市经委在各自的职责范围内,负责本办法的解释。

第二十四条 本办法自市政府同意之日起试行。

Trial Implementation Procedures of Shanghai Municipality on the Subscription to and Marketing of Green Electricity

Chapter I General Provisions

Article 1For the purposes of pushing forward the development and utilization of green electricity in this Municipality, improving the energysource composition, promoting the protection of environment and the sustainable development, and creating a good atmosphere of the whole society showing concern about the development of green electricity, these Procedures are formulated in accordance with the provisions of the“Law of the People's Republic of China on the Economization of Energy”and the“Law of the People's Republic of China on Renewable Resources”and other relevant laws and regulations, and in the light of the actual circumstances of this Municipality.

Article 2 The term“green electricity”mentioned in these Procedures refers to the electricity that is produced by such renewable energy as wind energy, solar energy, etc. for connection onto the grid.

Article 3 The government, electricity enterprises, and the society shall jointly support the construction of green electricity projects.

Article 4 This Municipality encourages the development of green electricity, and encourages the units and individual persons to voluntarily subscribe to green electricity.

Article 5 Shanghai Municipal Development and Reform Commission (hereinafter referred to as SMDRC) and the Shanghai Municipal Economic Commission (hereinafter referred to as SMEC) shall, in accordance with their respective duties, be in charge of the supervision and administration over the subscription to and marketing of green electricity.Shanghai Municipal Energy Conservation Supervision Center shall be in charge of the routine supervision and administration over the subscription to and marketing of green electricity.Shanghai Electricity Company, the Chongming Electricity Company (hereinafter jointly referred to as electricity company) are the marketing unit of green electricity in this Municipality.

Chapter II Subscription to and Sale of Green Electricity

Article 6 The subscription fee to be paid by the units and individual persons subscribing to green electricity shall be calculated at the subscription unit price of green electricity and the quantity of green electricity subscribed to. The electric quantity subscribed to shall, according to the prescribed procedures, be voluntarily registered by users for subscription.

Article 7 The SMDRC shall arrange the annual guiding plan of green electricity. The subscription to and sale of green electricity shall be carried out in accordance with the annual plan, and the work of balancing the electric quantity for purchase and sale shall be well done by the electricity company. In case the electric quantity purchased surpass the electric quantity sold in the current year, it shall be carried over to the next year, and then the electric quantity sold shall be increased; in case the electric quantity purchased is smaller than the electric quantity sold in the current year, it shall be carried over to the next year and then the electric quantity sold shall be decreased.

Article 8 Application may be made for the subscription to green electricity by taking the form of making phone calls (Shanghai Electricity Hotline 95598), sending mails, registering on Shanghai green electricity website, or making registration at relevant business outlets of the electricity company, etc.A unit user will become the user of green electricity after signing the sales contract on green electricity with the electricity company. An individual user will become the user of green electricity after receiving and confirming in reply the postage paid mail from the electricity company.

Article 9 The minimum quota of quantity of green electricity subscribed to by a unit user shall be determined by taking 6000 kilowatt hours as a unit, and the electric quantity used by that user in the preceding year as the basic standard.

1. For the annually used electric quantity of not more than two million kilowatt hours, the minimum quota is 10 units;

2. For the annually used electric quantity of not less than two million kilowatt hours and not more than five million kilowatt hours, the minimum quota is 20 units;

3. For the annually used electric quantity of not less than five million kilowatt hours and not more than twenty million kilowatt hours, the minimum quota is 50 units;

4. For the annually used electric quantity of not less than twenty million kilowatt hours and not more than fifty million kilowatt hours, the minimum quota is 80 units;

5. For the annually used electric quantity of not less than fifty million kilowatt hours, the minimum quota is 100 units.The minimum quota of quantity of green electricity subscribed to by an individual user every year shall be 10 units (by taking 12 kilowatt hours as a unit).

Article 10 The term for the subscription to green electricity shall be one year, two years, or three years respectively. The subscription fees for green electricity shall be paid month by month through the current channel and methods of collecting electricity fees.

Article 11 The electricity company shall, according to the annual guiding plan of green electricity, carry out the marketing of green electricity, and set up relationship of purchase and sale of green electricity with definite users of green electricity. In addition, the electricity company shall make the statistical tables of the purchase and sale of green electricity every quarter and every year, and submit them to the SMDRC and SMEC. The Shanghai Energy Conservation Supervision Center shall carry out the supervision and administration over the quantity of green electricity purchased and sold, fee-charging, and the increase and decrease in the number of users year by year.

Chapter III Price Control for Green Electricity

Article 12 The on-grid price of the electricity produced by utilizing renewable resources shall be set by government or through public bidding. The government shall set the price on the principles of“Being beneficial to the promotion of the development and utilization of renewable resources, being economic and reasonable, reasonably compensating for the cost, and reasonably determining returns”. At present, the green electricity shall temporarily not participate in the price competition on the electricity market for going onto the grid, and later on, with the promotion of the reform of the electricity system, the competitive renewable resources market shall be set up and improved step by step.

Article 13 The difference in electricity charges due to the on-grid price of electricity generated by the renewable resources project exceeding that of electricity generated by conventional energy, shall be absorbed through the subscription procedures for green electricity, or shall, in accordance with the State provisions, shared in the selling price of electricity.

Article 14 The account for the subscription to green electricity shall be settled on the basis of the unit price of subscription and the electric quantity subscribed to. The unit price of the subscription to green electricity shall be determined by the difference in price between the annual average on-grid price of green electricity and the model on-grid price of electricity produced by Shanghai coal-fired new generators as examined and verified by the State, and the municipal price control department shall examine and approve such unit price once a year, and publish it along with the annual subscription plan.

Article 15 The renewable resources project of generating electricity shall reduce the cost of green electricity through the measures of public bidding, strict assessment, strengthened management, and technological progress, and the mechanism of controlling the cost of green electricity shall be set up and improved step by step.

Chapter IV Methods of Encouragement

Article 16 Shanghai Municipal Energy Conservation Supervision Center shall regularly make public the list of users of green electricity, and award the honorary certificates to the users who have subscribed to green electricity.

Article 17 For the users of green electricity who have signed with the electricity company a contract for a term of two or more years, and annually subscribed to green electricity in the quantity of more than one million kilowatt hours, with the quantity of green electricity subscribed to accounting for not less than 10% of the electric quantity annually used for the manufacture of their main products, the SMDRC and SMEC shall entrust the Shanghai Municipal Energy Conservation Supervision Center to issue them the emblem of green electricity. The users who have obtained the emblem of green electricity may use such emblem within the period of purchase.

Article 18 For the users making outstanding achievements in subscribing to green electricity, the SMDRC and SMEC shall award medals to them.

Chapter V Supervision and Administration on Green Electricity

Article 19 The electricity company shall set up the account for green electricity, and add a column of purchase for green electricity in the electricity bill for the users of green electricity, and regularly make public the situation of the production, purchase and sales of green electricity.

Article 20 The SMDRC shall regularly check the annual plan of green electricity, and the situation of implementing the price and using the funds, and shall every year entrust the auditing organs to carry out the auditing work on the situation of implementing the price and using the funds of green electricity.

Article 21 The municipal quality and technology supervision department shall strengthen the supervision and administration over the metrological apparatuses used in the settlement of account in the trade of green electricity, and carry out the investigation and handling of the illegal metrological acts in accordance with law.

Article 22 Shanghai Municipal Energy Conservation Supervision Center shall keep informed of the situation of the subscription to and marketing of green electricity, and regularly submit the situation report to the SMEC, put forward suggestions on relevant measures, assist the marketing units to formulate and implement the marketing plan of green electricity. In addition, entrusted by the SMDRC and SMEC, the Shanghai Municipal Energy Conservation Supervision Center shall issue the emblem of green electricity, and stop the acts of illegally using such emblem.

Chapter VI Supplementary Provisions

Article 23 The SMDRC and the SMEC shall, within the scope of their respective duties, be responsible for the interpretation of these Procedures.

Article 24 These Procedures shall be put into effect for trial implementation on the date of approval by the Municipal People's Government.
