Article 1 These Provisions were formulated for the purposes of strengthening the protection of Olympic intellectual property rights, protecting the lawful rights and interests of the Olympic proprietors and related rights proprietors, and ensuring and promoting the sustained and healthy development of the Olympic Games.

Article 2 The Olympic intellectual property rights mentioned in these Provisions refer to the proprietary rights of the Olympic intellectual property rights proprietors over any trademarks, special symbols, patents, works and other creations related to the Olympics as stipulated in the Olympic Charter and any agreements concluded by the Beijing Municipal People's Government and the Chinese Olympic Committee (hereafter, the COC) with the International Olympic Committee (hereafter, the IOC).

Olympic intellectual property rights owners and the related rights owners refer to the IOC, COC, the Organizing Committee of Games of the XXIX Olympiad (hereafter, the BOCOG), and legally authorized licensees.

Article 3 The trademarks, special symbols, patents, works and other creations related to the Olympics mentioned in these Provisions refer to:

1. the Olympic symbol (five Olympic Rings), Flag, Anthem, Motto as well as the terms or designs containing the words OLYMPIC, OLYMPICS, OLYMPIAD, OLYMPIC GAMES, or any type of combination thereof;

2. the emblem and title of the COC;

3. the logos, mascots, names, symbols (including Beijing 2008), anthem and slogans developed by the Beijing 2008 Olympic Games Bid Committee and the BOCOG or others entrusted by them for their use during the period when Beijing bid for or host the Games of the XXIX Olympiad; and

4. other Olympic intellectual property rights objects related to the Olympics.

Article 4 These Provisions shall apply to any acts related to Olympic intellectual property that occur in the administrative area of this Municipality.

Article 5 The protection of Olympic intellectual property rights shall comply with the principles of safeguarding the dignity of the Olympic Games, prohibiting any infringement of proprietary rights, as well as protecting and using such rights according to law.

Any organizations and individuals should safeguard the Olympic intellectual property.

Article 6 The use of Olympic intellectual property shall help the development of the Olympic Games.

The Olympic intellectual property rights specified in Items (1), (3) and (4) of Article 3 hereof may only be used after it has been approved and authorized by the BOCOG or organizations authorized by the IOC; the Olympic intellectual property rights specified in Item (2) of Article 3 hereof may only be used after it has been approved and authorized by COC.

Article 7 No organizations and individuals may assume the names of IOC, COC and BOCOG for such activities as soliciting contributions or sponsorship, producing or publishing advertisements and organizing propaganda.

Article 8 The following acts that infringe upon Olympic intellectual property rights are prohibited:

1. using the same or similar trademarks, special symbols, patents, works and other creations without authorization in production, business operations, advertising, propaganda, performance and other activities;

2. forging or making without authorization representations of the same or similar trademarks or special symbols, or selling representations of the same or similar trademarks or special symbols that are forged or made without authorization;

3. using the same or similar trademarks, special symbols, patents, works and other creations in a disguised form;

4. using the same or similar trademarks, special symbols, patents, works and other creations without authorization in registration of enterprises, social organizations, institutions, private non-profit-making work units, and in the names of websites, domains, toponymy, buildings, structures, places, etc.;

5. assisting in acts of infringement by providing convenient conditions such as venues, storage, transportation, mail service or concealment; or

6. other infringements in violation of relevant laws and regulations of the State.

Article 9 Advertisers, advertising agents and advertisement publishers shall not infringe upon the Olympic intellectual property rights in the design, production, agency service and publishing of advertisements; advertising agents and advertisement publishers shall strengthen their examination in advertising activities (including public welfare advertisements), and strictly verify the documentary evidence thereof.

Article 10 The municipal people's government authorizes the municipal intellectual property office to be responsible for such work as investigation and research, overall planning and integrated coordination for the protection of Olympic intellectual property rights.

The municipal administrative departments of industry and commerce, intellectual property, copyright, etc. shall strengthen their law enforcement and investigative efforts in relation to the protection of Olympic intellectual property rights. The administrative departments of press, culture, customs, public security and urban management and inspection, etc. shall do well to protect Olympic intellectual property rights in accordance with their respective duties and responsibilities.

Article 11 Any organization and individual may report any activity in violation of Olympic intellectual property rights to the administrative departments of industry and commerce, intellectual property rights, copyright, etc.; and shall be rewarded if the case reported proves to be true.

Article 12 In the event of any violation of these Provisions and infringement of Olympic intellectual property rights, the administrative departments of industry and commerce, intellectual property rights, copyright, etc. may take the following measures:

1. order the discontinuation of such infringement activities and eliminate its impact;

2. seal up any relevant article of property or material, that may be transferred, concealed or destroyed;

3. remove from the existing objects any counterfeit trademarks, special symbols, patent marks, works and other creations;

4. seize and destroy the infringing trademarks, patent marks and special symbols;

5. seize the moulds, printing plates and other tools directly used in infringement activities; or

6. order and monitor the destruction of infringing trademarks, special symbols, patents, works and other creations that are difficult to be separated from the existing objects.

Article 13 One who infringes the Olympic intellectual property rights shall bear the corresponding civil liability according to law.

Article 14 Any infringement of the Olympic intellectual property rights in violation of these Provisions and relevant laws, regulations and rules shall be handled according to law; where there are no provisions in the relevant laws, regulations or rules, a fine of not less than Rmb 1,000 and not more than Rmb 30,000 shall be imposed; where the infringement constitutes a crime, criminal liability shall be pursued according to the law.

As for the administrative penalties stipulated in the preceding paragraph, infringement activities involving trademarks, special symbols, advertisements, enterprise registration and website names shall be investigated and handled by the administrative department of industry and commerce; patent infringements shall be investigated and handled by the administrative department of intellectual property rights; infringements on copyrights shall be investigated and handled by the administrative department of copyright; infringements involving other areas shall be investigated and handled jointly by the administrative department of intellectual property rights and the administrative departments of relevant industries.

Article 15 In the event that the rights of the proprietor or related rights proprietors have been infringed upon, the respective proprietor may lodge a complaint with the relevant department at the place where the infringement occurred or directly file a lawsuit with the people's court.

When dealing with an infringement case, the relevant administrative department may carry out mediation according to law; where the mediation fails, the proprietor may file a lawsuit with the people's court.

Article 16 With respect to the infringement of Olympic property rights prior to the implementation of these Provisions, the perpetrator shall immediately cease the act and eliminate the impact thereof; any infringement activity that was registered and authorized shall be corrected by the relevant administrative department.

Article 17 These Provisions shall be effective as of 11 November 2001.
