上海市禁止制造销售使用简陋锅炉和非法改装常压锅炉的规定 第一条 (目的) 为了消除非法制造、销售、使用简陋锅炉和将常压锅炉改为承压使用产生的事故隐患,保障人民生命财产安全,根据国家有关规定,结合本市实际情况,制定本规定。 第二条 (含义) 本规定所称的简陋锅炉,是指不按照国家标准设计、不采用标准材质或者不按照规定工艺制造的产生蒸气或者热水的承压设备(以下简称土锅炉)。 本规定所称的常压锅炉,是指锅炉本体开孔或者用连通管与大气相通,在任何情况下锅炉本体顶部表压为零的热水锅炉。 第三条 (遵守有关法律、法规、规章的规定) 生产者和经营者应当依照有关法律、法规和规章的规定,制造、销售符合国家质量标准的锅炉。 本市豆制品、食品、木材、服装等加工场(厂)以及洗衣、理发、浴室、建筑工地等场所使用的锅炉,应当符合国家和本市的有关规定。 第四条 (禁止制造、销售、使用土锅炉的情形) 任何单位和个人不得用油桶、柏油桶或者其他容器改装、用劣质材料卷制焊接或者制造筒型、非筒型结构的土锅炉。 任何单位和个人不得销售和使用土锅炉。 任何单位和个人不得为制造、销售土锅炉提供场地、设施。 第五条 (禁止将常压锅炉改为承压使用) 任何单位和个人不得将常压锅炉承压使用或者通过改变锅炉结构和安装系统管路、阀门等方式,将常压锅炉改装成承压锅炉。 第六条 (房屋出租者的提示义务) 房屋所有者将房屋出租给承租者用于豆制品、食品、木材、服装等加工场(厂)以及洗衣、理发、浴室、建筑工地等场所使用或者用于居住的,应当告诫承租者不得使用土锅炉、不得将常压锅炉改为承压使用。 房屋出租者发现承租者有违反第四条、第五条规定情况的,应当予以制止,并向质量技术监督部门或消防部门报告。 第七条 (社区监管) 各街道办事处、乡镇人民政府应当将本社区内豆制品、食品、木材、服装等加工场(厂)以及洗衣、理发、浴室、建筑工地等场所使用锅炉的情况,列入重点监控事项,并配置协管人员,加强日常检查和巡查。 街道办事处、乡镇人民政府发现有违反本规定的行为,应当告知停止使用,并及时向质量技术监督部门、安全生产监管部门和消防部门报告。 第八条 (告知) 在对豆制品、食品、木材、服装等加工场(厂)以及洗衣、理发、浴室等场所经营者办理登记注册时,工商行政管理部门应当告知其使用符合国家和本市规定的锅炉。 第九条 (执法信息的沟通) 质量技术监督部门应当及时将查处豆制品、食品、木材、服装等加工场(厂)以及洗衣、理发、浴室等场所使用土锅炉和将常压锅炉改为承压使用的情况,通知工商行政管理部门。 第十条 (举报和奖励) 鼓励对制造、销售、使用土锅炉和将常压锅炉改为承压使用的违法行为进行举报。 质量技术监督部门对举报的违法行为,经查实应当给予举报者适当奖励。 第十一条 (执法检查) 质量技术监督部门应当加强对锅炉使用情况的抽查,并根据需要开展专项检查。 质量技术监督、安全生产监管、工商行政管理、公安、消防等部门应当根据有关法律、法规、规章的规定,各司其职,加强对制造、销售、使用锅炉的行政执法的协调和沟通,并组织联合执法。对发生重大安全事故和整改不力的区域,应当予以通报。 第十二条 (行政处罚和行政强制措施) 制造、销售土锅炉的,按照《中华人民共和国产品质量法》第四十九条的规定,由质量技术监督部门责令停止制造、销售,没收制造、销售的土锅炉,并处制造、销售土锅炉(包括已销售和未销售的)金额等值以上三倍以下的罚款;有违法所得的,并处没收违法所得;情节严重的,由工商行政管理部门吊销营业执照。 对使用的土锅炉,由质量技术监督部门监督使用者拆除和销毁,并根据情节轻重对使用者处以1万元以上3万元以下的罚款。 为制造、销售土锅炉提供场地、设施的,按照《上海市产品质量监督条例》第四十二条规定,由质量技术监督部门没收其提供场地、设施所取得的非法收入,并可处非法收入一倍以上五倍以下的罚款;对责任人,可处500元以上5000元以下的罚款。 将常压锅炉承压使用,或者通过改变锅炉结构和安装系统管路、阀门等方式将常压锅炉改装成承压锅炉的,由质量技术监督部门责令改正,并处以5000元以上3万元以下的罚款。 房屋出租者不履行治安责任,发现承租者有利用所租居住房使用土锅炉和将常压锅炉改为承压使用等违法行为不制止、不报告的,由公安部门依法予以行政处罚。 第十三条 (民事和刑事责任) 对制造、销售、使用土锅炉和将常压锅炉改为承压使用,造成他人人身、财产损害的,依法承担赔偿责任;构成犯罪的,依法追究刑事责任。 第十四条 (实施日期) 本规定自发布之日起施行。2002年3月5日上海市人民政府颁布的《上海市禁止非法制造销售使用简陋锅炉的若干规定》同时废止。 Provisions of Shanghai Municipality on the Prohibition of Sale and Use of Simple and Crude Boilers and Illegal Refitting of Atmospheric Pressure Boilers Article 1 (Purpose) With a view to obviating hidden dangers caused by illegal manufacturing, sale, and use of simple and crude boilers and refitting atmospheric pressure boilers into pressured ones for use, safeguarding the safety of the people's lives and properties, these Provisions are formulated on the basis of the relevant regulations of the State and this Municipality, and in the light of the actual circumstances of this Municipality. Article 2 (Meaning) The term"simple and crude boilers"mentioned in these Provisions refers to the steam- or hot-water-producing pressure equipment which are not designed in accordance with the national standards, not made of standard materials or in accordance with prescribed technology (hereinafter referred to as"native crude boilers"). The term"atmospheric pressure boilers"mentioned in these Provisions refers to the hot-water boilers whose body is holed or open to the atmosphere by connecting pipes, and whose manometer reading on top of the body under any circumstances is nought. Article 3 (Abiding by the Provisions of Relevant Laws, Rules and Regulations) The producers and dealers shall manufacture and sell boilers which meet the quality standards of the State in accordance with the provisions of relevant laws, rules and regulations. The boilers used in the processing places(factories) of bean products, food, wood, clothing and other products, and the laundry stores, hairdressing shops, bathhouses and construction sites in this Municipality shall comply with the relevant provisions set by the State and this Municipality. Article 4 (Prohibition of Manufacturing, Selling and Using Native Crude Boilers) No unit or individual person shall make boilers of simple-structure type or non-simple-structure type by converting oil or tar drums or other containers, or by rolling or welding inferior materials. No unit or individual person shall sell or use native crude boilers. No unit or individual person shall provide sites or facilities for the manufacturing and sale of native crude boilers. Article 5 (Prohibition of Refitting Atmospheric Pressure Boilers into Pressure Ones for Use) No unit or individual person shall refit atmospheric pressure boilers for the use of being pressured, or through changing boilers'structure and installing system pipelines, valves etc., refit atmospheric pressure boilers into pressure boilers. Article 6 (House-lessors'Duty to Point out) House-owners who lease their houses to tenants who use these houses as processing places(factories) of bean products, food, wood, clothing or other products, or as laundry stores, hairdressing shops, bathhouses, construction sites or for residence, shall warn the tenants against using native crude boilers and refitting atmospheric pressure boilers into pressure ones for use. Where the house-lessors find the tenants violating Article 4 and Article 5, they shall stop the violation, and shall report it to the departments of quality and technology supervision or the fire departments. Article 7 (Community Supervision and Control) Sub-district offices and the township and town people's governments shall take as one of the key supervision and control items the use of boilers in the processing places(factories) of bean products, food, wood, clothing and other products and in the laundery stores, hairdressing shops, bath-houses and construction sites in their communities, provide assisting managing personnel, and shall strengthen the regular checks and inspection tours. Where the sub-district offices and the township and town people's governments discover the acts in violation of these Provisions, they shall notify the persons concerned to stop the use of boilers, and report in good time to the departments of quality and technology supervision, the supervisory departments of production safety and fire departments. Article 8 (Notification) In handling the registration of processing places(factories) of bean products, food, wood, clothing and other products, and of laundery stores, hairdressing shops and bath-houses, the administrative departments of industry and commerce shall notify the operators of these businesses to use the boilers in compliance with the provisions set by the State and this Municipality. Article 9 (Exchange of Information in Connection with Law Enforcement) The departments of quality and technology supervision shall pass to the administrative departments of industry and commerce in good time the information concerning their handling the cases of using native crude boilers and refitting atmospheric pressure boilers into pressure ones for use in processing factories of bean products, food, wood, clothing and other products and in laundery stores, hairdressing shops and bath-houses. Article 10 (Reporting and Rewarding) Reporting against the illegal acts of manufacturing, selling or using native crude boilers and refitting atmospheric pressure boilers into pressure ones for use is encouraged. The departments of quality and technology supervision shall grant appropriate rewards after verification to those who provide clues about using native crude boilers and refitting atmospheric pressure boilers into pressure ones for use. Article 11 (Law Enforcement and Inspection) The departments of quality and technology supervision shall strengthen the selective inspection on the use of boilers, and launch special inspection according to actual needs. The departments of quality and technology supervision, the supervisory departments of safe production, the administrative departments of industry and commerce, the departments of public security and the fire departments shall, in accordance with the relevant laws, rules and regulations, perform their respective functions and duties, strengthen the coordination and the exchange of information in administrative law enforcement in connection with manufacturing, selling and using boilers, and shall organize joint law-enforcing actions. Any area where grave safety accidents have occurred and no major improvements have been made shall be circulated in notices of criticism. Article 12 (Administrative Punishments and Administrative Enforcement Measures) Those who manufacture or sell native crude boilers shall, in accordance with Article 49 of the"Law of the People's Republic of China on the Quality of Manufactured Products", be ordered by the departments of quality and technology supervision to stop manufacturing or selling native crude boilers, with the native crude boilers (manufactured or to be sold) confiscated, and shall be cumulatively imposed a fine equivalent in value to not more than three times that of all the native crude boilers manufactured or sold (including those already sold and to be sold). Illegal gains, if any, shall be confiscated. The business license shall be revoked if the offence is serious. Any native crude boiler in use shall be demolished and destroyed under the supervision of the departments of quality and technology supervision, and the user shall be imposed a fine of between not less than 10,000 and not more than 30,000 yuan according to how serious the wrongful act is. Those who provide sites or facilities for manufacturing or selling native crude boilers shall, in accordance with Article 42 of the"Regulations of Shanghai Municipality on the Supervision of the Quality of Manufactured Products", shall be punished by the administrative departments of industry and commerce by confiscating their illegal gains from providing the sites or facilities and by imposing a fine of between not less than one and not more than five times the amount of the illegal gains. The liable person shall be imposed a fine of between not less than 500 and not more than 5000 yuan. Those who use atmospheric pressure boilers as pressure ones, or refit atmospheric pressure boilers into pressure ones through changing boilers'structure and installing system pipelines, valves etc. shall be ordered by the departments of quality and technology supervision to make a correction, and be cumulatively imposed a fine of between not less than 5,000 yuan and not more than 30,000 yuan. House-lessors who fail to perform the duty of public security and fail to prevent or report against the tenants'illegal act of using native crude boilers and refitting atmospheric pressure boilers into pressure ones for use in the leased houses shall be given administrative punishments by the departments of public security according to law. Article 13 (Civil and Criminal Liabilities) Anyone who has caused personal injury or property damage due to his/her manufacturing, selling and using native crude boilers or refitting atmospheric pressure boilers into pressure ones for use shall be liable for compensation, and shall be prosecuted for criminal liability if the wrongful act constitutes a crime. Article 14 (Effective Date) These Provisions shall become effective on the date of promulgation. The"Provisions of Shanghai Municipality on the Prohibition of Illegal Manufacturing, Sale and Use of Simple and Crude Boilers"promulgated on March 5, 2002 by the Shanghai Municipal People's Government shall be repealed on the same date. |
